Website and Application Terms and Conditions

This document is an electronic record in terms of the Information Technology Act, 2000 and the rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

 

These terms and conditions (“Terms”) apply on the usage of the iGiver website (www.igiver.org) (the “Website”), its smartphone Application titled ‘iGiver’ (the “Application”) as well as to all information, recommendations and/or services provided to you on or through the Website, Application or through any form of electronic communication including any communication made via any social media. The term ‘You’ refers to the user of our services through the Website or Application (“User”).

These terms, along with iGiver’s Privacy Policy, as amended and updated from time to time constitute the entire agreement between the User(s) with respect to access to and use of the Website/Application and the Services (as defined below), superseding any prior written or oral contracts in relation to the same subject matter herein. If these terms are not acceptable to you, please do not use the Website or Application or Services.

Services

iGiver offers a technology platform that connects Non-Governmental Organisations (“NGOs”) with potential donors (“Donors”) based on certain information provided to iGiver through the Website or Application (“Services”).

iGiver onboards certain NGOs onto its platform through its Application and Website and maintains a list of such NGOs along with a description of their areas of work, displayed on the Website and Application.

From time to time, Donors may list various products through the Application/Website up for donation to suitable NGOs. Upon the relevant NGO accepting such donation through the Website/Application, iGiver facilitates a connection between the NGO and the Donor, to enable them to arrive at the logistics of delivering/picking up the said products listed by the Donor on the Website/Application.

iGiver merely provides a platform for the NGOs and the Donors to connect on. iGiver does not provide any other services in relation to the product to be donated. iGIver may charge a platform fee for its services. By continuing to use the Website/Application, the User agrees to carry out their obligations under these Terms, and to act at all times in good faith.

iGiver shall not under any circumstances be liable for any defects in the products donated by the Donors to the NGOs. In the event that for any reasons whatsoever, the proposed donation by the Donor to the NGO does not go through, iGiver shall not be held liable whatsoever.

The User acknowledges that iGiver is not the manufacturer or dealer in relation to any of the products donated through the platform on the Website/Application.

 

User’s Eligibility

iGiver shall be the sole party that decides on the user base of the Website/Application. iGiver retains the right to refuse Services or to prevent access to the Website/Application by any User, at any time, for any reason whatsoever.

 

Consent to information provided to iGiver

The User has provided their personal information including their name/phone number/email address voluntarily. iGiver may contact the User on any of the contact details provided to iGiver. The User consents to receiving smses, emails etc on the contact details provided to iGiver. The User also consents to iGiver’s providing of the User’s information to NGOs/Donors (as the context may require, to facilitate the donation).

iGiver assumes that all information collected from the User is correct and accurate. Misuse and misrepresentation of identity or contact details could lead to automated termination of Services or use of the platform without prior notice to such Users.

 

Obligations of NGOs and Donors:

NGOS:

  • NGOs shall from time to time signify their interest in donations from the Donor through the Application/Website.
  • Pursuant to the Donor confirming their interest in donating to the NGO, the NGO shall act in good faith in connecting with the Donor through the contact information provided by iGiver, to procure the product(s) being donated.

 

Donors:

  • Donors may as and when required, list their products through the Website/Application for donation to the suitable NGOs.
  • Upon NGOs signifying their requirement through the Application/Website, the Donor must confirm the donation through the Application/Website. 
  • Upon such confirmation, the Donor agrees to be contacted by the relevant NGO, to facilitate the pickup/delivery of said product to the NGO.
  • All products listed by the Donor are until the point of donation, owned solely by the Donor.
  • Products listed by the Donor on the Application/Website shall remain listed for a period of 90 (Ninety) days, following which the same shall be automatically removed, if no requirement has arisen on the part of a NGO.
  • In the event that a listed product is no longer available for donation, the Donor shall at the earliest point in time cause for de-listing of the product on the Application/Website.
  • Returns and refunds are not accepted whatsoever by iGiver as each instance of donation is not treated as a ‘purchase’ of goods but as a donation.

 

Limitation of Liability

The Donor understands and agrees that any donation made through the iGiver platform shall be construed solely as a donation. The Donor also expressly agrees that there shall be no claims against iGiver whatsoever in relation to the Services. iGiver may be required to treat the donations made by the Donor appropriately as may be required from time to time to ensure that the same reaches the NGO of the Donor’s choice (including but not limited to by transferring the donation made to a third party wallet), for which the Donor waives any and all rights to make claims against iGiver.  

 

General Usage Conditions

The User has understood these Terms with iGiver and has also understood the terms and conditions of the Services.

The User shall use the Application/Website for the purposes intended by iGiver only. Failure to do so may result in iGiver revoking access to its platform.

The User confirms that the Services/Application/Website is not being used for any unlawful purposes whatsoever. This shall include any activity such as hacking/data theft etc.

Any and all intellectual property in relation to the Services/Application/Website shall solely be the property of iGiver. Nothing in these Terms shall be construed as an assignment or transfer of any intellectual property whatsoever.

In the event of any defects in the products donated by the Donors, the respective NGOs and Donors agree to resolve the issues amicably, by negotiations in good faith. iGiver shall not be responsible in the event of any disputes arising in relation to the products, whatsoever. 

 

Consent

By clicking the “Login”, “Register”, or “I Agree” button, You consent to conduct transactions and receive communications, notices and information from us electronically, whether sent by e-mail or other electronic means. Electronic communications shall be deemed to have been received by You when we send the electronic communication to Your email address / mobile number per our records, or when we post the electronic communication on the Application or the Website.

 

Choice of law and Dispute Resolution

The Terms shall be governed by and construed in accordance with the laws of India without reference to principles of conflicts of law. Any and all disputes arising from or relating to these Terms shall be resolved amicably by negotiations between the parties. Upon failure to arrive at a resolution, courts at Madras shall have exclusive jurisdiction over the disputes.
